The plaintiffs/appellees, North Fork Bank (“NFB”) as the non-bankruptcy trustee of Group Trust No. 47 (“GT 47”), and the Official Committee of Investors (the “Committee”) in GT 47’s chapter 11 case currently pending before the United States Bankruptcy Court for the Eastern District of New York move the Court pursuant to Federal Rule of Bankruptcy Procedure 8003 to dismiss the appeal taken by the defendani/ap-pellant Richard H.
