This was a proceeding in the county court of Jo Daviess county, commenced by the Freeport and Mississippi Biver Bailway Company, to condemn a strip of land one hundred and fifty feet wide, in Jo Daviess county, owned by Ulysses Gr. Scheller DeBuol, upon which the company had located its line of road. The appellant, as appears from the record, owned fifty-four acres of land, which he occupied as a residence, a portion of the land as a garden, and a portion as a vineyard.
