Bickford and Sherrod brought separate actions against the Southern Oil Works to recover damages for the destruction of their respective houses by the same alleged wrongful act of the corporation. The cases were tried together by consent of the parties, and resulted in a verdict and judgment in favor of the plaintiffs below. The Southern Oil Works appealed in error, and the Referees report that the judgment should be reversed for errors in the rulings of the trial judge upon the admission and rejection of evidence, and because there is not sufficient evidence to sustain the verdict as to the…
