United Gas Pipe Line Company (United), in its March 31, 1982, rate change filing with the Federal Energy Regulatory Commission (FERC),1 included a “tracker” designed to apply to all of United’s transportation costs and revenues. The proposed tracker, which would yield automatic, semiannual rate adjustments, concededly contravened a longstanding rate regulation policy currently stated in an explicit FERC regulation.2 FERC refused to waive the regulation and…
