The accident by which Carpita met his death killed George Lamb. It is completely detailed in the statement made in *256the preceding case. We deem it wholly unnecessary to repeat the facts, and regard it as sufficient, for the purposes of this decision, to refer to that opinion, and add such matters as are essential to emphasize the distinction between the two actions, and to make plain what is necessary for an adequate discussion of those things which are essential to the disposition of this controversy.
