This suit is before me on defendant’s motion to dismiss. By it plaintiff seeks the cancellation of a general health and accident policy of insurance issued by it to defendant September 2, 1924, and recovery of $1,985.-69 theretofore paid by it to him under the poliey. The ground upon which such relief is sought is that plaintiff was induced to issue the poliey by fraudulent misrepresentations as to material matter.
