The complaint alleged that on or about October 10th, 1929, the plaintiff made a draft for $2952, directed to the Hanover National Bank of New York, payable to the Chicago Live Stock Exchange, which draft came wrongfully into the possession of John Schmidt, Jr., who forged the indorsement of the payee and deposited it to his credit with the defendant, who thereupon indorsed it, the plaintiff paid it to the defendant through the Hartford Clearing House, now holds the same, and has demanded the amount thereof from the defendant, who refuses to pay it.
