The defendants other than the administrator Bowman appeal from the order denying a new trial. Plaintiff’s action was for specific performance of a contract made in his behalf with Christian Frederick Wilhelm Johnson, deceased. Defendant Bowman is the administrator of the deceased’s estate, and the other defendants are heirs of the deceased. The complaint alleged in substance that in 1890 the deceased Johnson and his wife, being childless and desiring plaintiff, who was then about six and a half years old, to come into their home, agreed with plaintiff’s parents, acting in behalf…
