Mrs. Chase, as community survivor of her deceased husband, George L. Chase, brought this suit to recover damages for a breach of a contract for the sale of land made by. Prank Kimbrell with her deceased husband. Kimbrell, among other things, pleaded a written agreement between himself and George L. Chase, canceling the contract for the sale of the land, by the terms of which Chase was to pay the balance of the first payment, $150, on or before the 8th day of March, and if not paid at that time Chase was to vacate the land and surrender any claim to the $100 deposited by him as a forfeit, and…
