I. Background
On March 24, 2003, plaintiff Colleton Preparatory Academy, Inc. (“Colleton” or “plain*403tiff’) filed an action in this court against Beazer East, Inc. (“Beazer”) and Hoover Treated Wood, Inc. (“Hoover Wood”) alleging various causes of action for negligence and violations of the South Carolina Unfair Trade Practices Act.
