MEMORANDUM DECISION AND ORDER

WINDER, District Judge.

This matter is before the court on defendant’s motion for summary judgment and plaintiff’s cross-motion for summary judgment. A hearing was held on these motions on July 11, 1989. Defendant, State Farm Insurance (“State Farm”), was represented by Paul M. Belnap. Plaintiff, John Wagenman, was represented by D. David Lambert. Prior to the hearing, the court had reviewed carefully the memoranda submitted by the parties.
