MEMORANDUM OPINION AND ORDER

EDWARD J. BOYLE, Sr., District Judge:

This matter is before the court upon the motions of defendant, R. B. Potashnick (Po-tashnick), to stay the Order of the Magistrate entered herein on May 14,1979, and to Review the Magistrate’s Order. Following oral argument on the motions, the court granted the defendant’s Motion to Stay the Order of the Magistrate pending its ruling on the Motion to Review. Having taken time to consider the matter, the court is now ready to rule.
