The defendant was tried on four charges: kidnapping his son, kidnapping his daughter, kidnapping their mother, and assaulting and battering the mother with a dangerous weapon, a shod foot. The judge, at the close of the Commonwealth’s case, ordered required findings of not guilty on the indictments charging kidnapping of the defendant’s children. The case went to the jury on the other two charges (in which the children’s mother was the alleged victim), and the jury returned a verdict of not guilty on the kidnapping charge and guilty on the charge of assault and battery with a dangerous…
