WOLVERTON, District Judge.
On May 6, 1911, the defendant,. S. A. Keenan, advanced $250 earnest money for tire purchase of 140 acres of land situated in Jackson county, Or.; Huntley-Kremer Company representing the vendors. It was a condition of the contract then entered into respecting the purchase of the land by Keenan that, ■ as soon as the title was found to be good by the purchaser and the soil satisfactory, Keenan should pay the balance of tire purchase price in manner stipulated.
