INTRODUCTION

This action came before the Court for a non-jury trial on January 8th and 9th, 2007. The Court heard the testimony of twelve witnesses, reviewed the exhibits admitted into evidence, considered the parties’ Joint Pretrial Stipulation and Supplemental Joint Pretrial Stipulation. This is an action for payment on a promissory note (the “Note”). Defendants, Lourdes Zaczac and Georgi Zaczac, acknowledge the existence of the Note and its nonpayment.
