Appeal from judgment of the General Term of the Supreme Court in the fifth judicial department, entered upon an order made at the June term, 1893, which affirmed a judgment in favor of plaintiff entered upon the report of a referee. This action was brought to recover possession of seventy freight cars, alleged to be the property of plaintiff, and which had been taken possession of by defendant as receiver of the Rochester, Hornellsville and Lackawanna Railroad Company.
