In an action, inter alia, to rescind a portion of a separation agreement, the defendant husband appeals from an order of the Supreme Court, Queens County (Joy, J.), dated March 10, 1988, which denied his motion for summary judgment dismissing the complaint.
Ordered that the order is reversed, on the law, without costs or disbursements, the motion is granted, and the complaint is dismissed.
