In an action for a divorce and ancillary relief, the plaintiff wife appeals from an order of the Supreme Court, Kings County (Rigler, J.), dated January 23, 1987, which denied her motion for summary judgment on her cause of action for a conversion divorce and to dismiss the defendant’s counterclaim for rescission of the separation agreement.

Ordered that the order is reversed, on the law, with costs, and the plaintiff’s motion for summary judgment on her cause of action for a conversion divorce and to dismiss the defendant’s counterclaim is granted, and the case is remitted to the Supreme…
