Defendant, Louis Jordan, appeals after a verdict and a sentence to serve six years as a prior and persistent offender on a charge of unlawful use of a weapon. Section 571.030 RSMo Cum.Supp.1997. We granted leave to file a late appeal. The state charged Defendant with flourishing a handgun in an angry or threatening manner at his ex-girlfriend.
