The present case arises from a 1983 public works contract for the creation of a water pipeline in Elk County, Kansas. Rural Water District No. 1 of Elk County entered into a general contract with Bobby Goins Enterprises for the construction of the pipeline. Goins subsequently entered into a contract with Blinne Contracting Co. for Blinne to perform subcontracting work on the pipeline project.
