BACKGROUND
Joseph W. Alcaraz, along with three other individuals, was charged by information on July 1, 1996, with first degree forcible sexual assault. Both Alcaraz and the State allege that this charge was amended to first degree sexual assault approximately 2 years later, although the record does not contain an amended information. Alcaraz was arraigned in the district court for Douglas County, Nebraska, on July 2 and pled not guilty. In an order filed November 22, the district court consolidated the trials of Alcaraz, Fred A.
