INTRODUCTION

Londe S. Roundtree appeals from an order overruling his motion for complete discharge upon the basis that he was denied a speedy trial. The controlling issue is whether Roundtree’s rights to a speedy trial were violated when the court granted the State’s oral motion for a continuance that necessitated setting the trial after the 6 months allowed under Neb. Rev. Stat. § 29-1207 (Reissue 1995), since the only showing for the continuance was the unsworn statements of the prosecutor that the continuance was necessary because the State could not arrange for three…
