PHILLIPS, District Judge.

The National Surety Company brought this action against Edward E. Jenkins, as receiver of the National City Bank of Salt Lake City, Utah, to compel the allowance of its claim upon an indemnity agreement entered into between the bank and the National Company and the payment of dividends thereon. The receiver answered and prayed that the American Surety Company and E. J. Groesbeek be required to interplead in the action.
