Plaintiff in error, Russell T. Scott, (hereinafter referred to as the defendant,) was tried and found guilty by a jury in the criminal court of Cook county of the murder of Joseph M. Maurer. The jury by its verdict fixed the punishment at death, and the court on February 14, 1925, entered judgment and sentence that he be hanged by the neck until dead, between the hours of sunrise and sunset on April 17, 1925.
