Petitioner was tried by general courts martial on July 11, 1951, for violation of Article 134, Uniform Code of Military Justice, 50 USC § 728. The two specifications under the charge alleged assault with intent to commit murder upon (1) First Lieutenant Richard C. Rock, and (2) Corpoi'al Freddie Phillips, Jr. He pleaded not guilty to the charge and specifications, and was found guilty of the charge and specification (1), and not guilty of specification (2).
