Presently before the Court in this civil action are cross motions for summary judgment filed by both the plaintiff and the defendant. Plaintiff Joseph D. Stout has brought suit individually and as personal representative of the estate of his deceased brother, Dr. Henry W. Stout (hereinafter “Dr. Stout”).
