Before entering upon the consideration of the rulings occurring on the trial upon whicli error is specially alleged, it is necessary to look into the questions submitted affecting the jurisdiction of title circuit court; for, unless it appears that that court acquired jurisdiction by the removal proceedings, it is clear that we cannot proceed to discuss the merits of the controversy.
