OPINION
BROTMAN, District Judge.
Presently before the court are plaintiffs motion to remand this matter to the state court of original jurisdiction pursuant to 28 U.S.C. § 1447(c), and defendants’ motions to confirm this court’s subject matter jurisdiction, to dismiss or, in the alternative, for partial summary judgment. In addition, the third party defendant has moved to dismiss the third party amended complaint.
