OPINION AND ORDER

Pending before the Court is defendant Fernando Bonilla’s (“Bonilla” or “Defendant”) motion for summary judgment (Docket No. 131). For the reasons set forth below, the Court GRANTS the Defendant’s motion.

I. BACKGROUND

Plaintiff Prudencio Mendez-Aponte (“Mendez” or “Plaintiff’), his wife Maria de los Angeles Lopez and the Conjugal Partnership constituted between them (hereinafter collectively referred to as “Plaintiffs”) filed the above-captioned claim on June 27, 2006 against several defendants.
