SPARKS, Circuit Judge.

Appellant charged appellee with infringing claims 2 and 51 of United States patent No. 1,392,584 to Lewis and Cooke, and claims 1 and 2 of United States patent No: 1,851,526 to Shaeffer and Brown. Appellee pleaded non-infringement and invalidity. The court held that the claims *489in issue were invalid for lack of invention, and that there was no infringement of the Shaeffer and Brown patent. It held, however, that there was infringement of the Lewis and Cooke patent, if that patent were valid.
