This is an appeal from a judgment and sentence, upon a verdict of murder in the first degree, with the penalty fixed at life imprisonment.

On the evening of Sunday, April 30, 1933, at about 11:30 o’clock, the defendant returned to his home, No. 1409 N. 13th Street, Philadelphia, where he lived with his wife, Jeannette Glenn. There they occupied a rear apartment, consisting of three rooms on the first floor. He found a “party” was being held, with drinking and dancing, and the guests were noisy and boisterous.
