Appellant was convicted of first degree murder with imprisonment for life as a penalty. A number of bandits attempted to rob an armored car of the Belmont Trust Company in Philadelphia as it stood on the east side of 49th Street in front of that bank. In the struggle that ensued, Thomas Kennedy, one of the bank guards, was killed and another seriously injured.
