The amended complaint alleges that the defendant, Baltimore and Ohio Railroad Company, is a railroad corporation organized under the laws of the State of Maryland, that it operates various lines of railroad through portions of the State of West Virginia and other States of the Union, and is engaged as a common carrier in interstate commerce shipments and transportation between the State of West Virginia and other States, more particularly the States of Rhode Island and New York.
