OPINION

SEARS, Justice.

Kristine Saveli brings this appeal from a summary judgment in favor of appellees and a denial of her motion for partial summary judgment. In the underlying suit for partition and accounting of real properly, appellant brought suit against her brothers, Tracy Saveli and James Saveli, and trustees Lelia Hanks and Johnnie May Ak-ers. Wharton Saveli, the father of the three children, intervened alleging that he owned a life estate to the property in question.
