OPINION
GRABER, Circuit Judge:
California’s Resale Royalty Act requires the seller of fine art to pay the artist a five percent royalty if “the seller resides in California or the sale takes place in California.” Cal. Civ.Code § 986(a). Plaintiffs in these consolidated appeals are artists and the estates of artists. Sitting en banc, we address Plaintiffs’ allegation that Defendants — two auction houses and an online retailer- — violated the Act by failing to pay mandatory royalties…
