This is an appeal on questions of law from the Court of Common Pleas of Clinton County.

The Board of Education of the Wilmington, Ohio, City School District decided that it was necessary to enlarge the grounds of the Wilmington Junior High School. The propriety of such decision is not disputed. Thereupon, negotiations were undertaken with the owner, appellee here, to acquire the land desired. When such negotiations failed, the board filed appropriation proceedings under Chapter 163 of the Bevised Code and declared its intention to take possession; whereupon, three thousand dollars was…
