Plaintiff Regions Bank d/b/a Regions Funding (“Regions”) commenced this action against defendants Wieder & Mas-troianni, P.C. and Peter Mastroianni (collectively “defendants” or “W & M”) alleging conversion and breach of fiduciary duty. W & M in turn filed a Third-Party Complaint against The Provident Bank, Inc. d/b/a Provident Consumer Financial Services, Inc. (“Provident”) and Morning Star Mortgage Bankers, Inc. and Angela Daidone (collectively “Morning Star”). 1 W & M now moves for summary judgment on the grounds that: (1) Regions’…
