The Federal Bureau of Investigation (“FBI”) began to investigate Plaintiff Anthony Sciacca (“Sciacca”) in the late 1990s as part of a wider investigation into an organized crime group. (Second Declaration of David M. Hardy (“Hardy Decl.”), ECF No. 12-1, ¶ 5.) On May 7, 2001, Sci-acca pled guilty in the United States District Court for the Eastern District of New York to a charge of racketeering in violation of 18 U.S.C. § 1962(c), and on November 8, 2001, a judge of that court sentenced Sciacca to 23 years in federal prison,…
