The plaintiff, Gilda Malek, filed this action against the defendant Flagstar Bank, a federally chartered savings bank, to challenge the recording of a deed of trust that was executed by the plaintiffs husband in exchange for a $500,000 loan secured by the couple’s house. See generally Compl,, ECF No. 1. The defendant has moved, -under Federal Rule of Civil Procedure 12(b)(6), to dismiss the Complaint for failure to state a claim.
