OPINION
MILLER, Judge.
This case is before the court on defendant’s third dispositive motion. Complicating adjudication of this case is the fact that plaintiff has reformulated its complaint three times. The first dispositive motion was filed in the first action; the second was addressed to the first complaint in this action; the third, to the second complaint. After the court dismissed plaintiff’s complaint in the first action, plaintiff reformulated its claims into seven claims for relief in the complaint that initiated this action.
