The families to which the parties belong are neighbors, living about a mile apart, and in December, 1926, the defendant signed a complaint against the plaintiff before a justice of the peace of the county of McIntosh charging the plaintiff with the crime of forgery in the third degree. A warrant for arrest was issued; the defendant waived a preliminary examination; was held to answer to the district court upon said charge and gave bail for his appearance.
