This was an action by the appellee against the appellant. The complaint consisted of three paragraphs. The defendant demurred separately to each paragraph, on' the ground that it did not state facts sufficient to constitute a cause of action, and the demurrers were all overruled.. The defendant then moved the court to strike out part of' the third paragraph <?f the complaint, which motion was also overruled.
