The record shows, that plaintiff is a corporation organized for the purpose of carrying on a general ■dry goods business. The point was raised on the trial, and preserved for review, that it did not possess power to acquire ■by assignment claims for damages in no way connected with its own affairs, growing out of the alleged conspiracy to defraud.
