It is argued tbat tbe functions of tbe personal representatives of Jeremiab M. Rusk, deceased, bad terminated at tbe time tbey were given tbe right to file tbe cross-bill in tbis action, and tbat tbey therefore could not prosecute it for tbe benefit of bis estate and of the legatees imder bis will.
