Plaintiff-insurer filed this declaratory judgment action against its insured, Defendant Atchley, Russell, Waldrop & Hlavin-ka, et. al. (“Atchley Russell”). Atchley Russell counterclaimed for declaratory judgment. Both parties seek a determination of their rights and obligations under a professional malpractice insurance contract. Now before the Court are the parties’ cross motions for summary judgment on the duty to defend and the duty to indemnify (Dkt. Nos. 33 & 34).
