This is a deed foreclosure and breach of contract case. Plaintiff Alpine Bank (hereinafter “Plaintiff’ or the “Bank”) alleges that Defendants and Third-Party Plaintiffs Platt T. Hubbell and Kelley S. Hub-bell defaulted on a promissory note to Plaintiff without justification, entitling the Bank to recovery.
