Plaintiff, Papa John’s International, Inc., (“Papa John’s”), and Defendants, Dynamic Pizza, Inc., et al., (“Defendants”) entered into a series of agreements, including Development, Franchise and Workout Agreements, in which Defendants became the franchisee of a number of Papa John’s restaurants in upstate New York. Papa John’s brought this suit against Defendants under federal intellectual property claims, a Kentucky state trade secrets claim, and a breach of contract claim.
