This case involves various claims made by Plaintiffs, Long John Silver’s, Inc. and A & W Restaurants, Inc. (“A & W”) against Patrick Nickleson1 and three of his business entities2 (collectively “Defendants”) in connection with a series of failed restaurant franchises in Minnesota. Defendants have filed three counterclaims against A & W particular to the A & W franchise in Inver Grove Heights, Minnesota (“Inver Grove Franchise”), alleging violations of the Minnesota Franchise Act (“MFA”) and common law fraud.
