This is an original mandamus proceeding in this court whereby it is sought to compel the defendant judge of the Circuit Court for Multnomah County to sign a bill of exceptions in terms prescribed in the alternative writ. Prom the recitals of that document it appears that, in a divorce suit wherein the plaintiff here was plaintiff and Prank Kubik was defendant, the court over which the present defendant presided as judge entered a decree April 28, 1913, dismissing the complaint at the cost of the plaintiff thérein.
