McDONALD, District Judge.

Pending before the Court, are the parties’ competing summary judgment motions. Defendant’s motion requests this Court to dismiss the above-captioned action on the basis of a maritime release executed by plaintiff on September 16, 1976. Plaintiff’s motion requests the Court to find that this release is not a bar to plaintiff’s suit.
